These Terms of Service govern your use of the ArkXFragrance website and your purchase of products from ArkXFragrance (the “Store,” “we,” “us,” or “our”). By visiting the Store or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy, and Return and Refund Policy.

1. Store and products

ArkXFragrance is an independent fragrance-decanting shop based in Jaffrey, New Hampshire. Unless a listing expressly says otherwise, products are independently filled fragrance decants taken from authentic source bottles and transferred into new travel atomizers. ArkXFragrance is not affiliated with, endorsed by, or sponsored by the fragrance brands referenced on this site. Brand names and original-bottle images are used only to identify the fragrance being decanted.

Fragrance descriptions, note lists, comparisons, longevity estimates, compliment claims, and spray-count estimates are subjective or approximate and may vary by skin, climate, storage, atomizer output, and personal perception. Product color and fill appearance may vary slightly.

2. Eligibility and acceptable use

You must be legally able to enter into a binding agreement in your jurisdiction or use the Store with the permission and supervision of a parent or legal guardian. You may not use the Store for unlawful, fraudulent, abusive, or unauthorized purposes; interfere with Store security; submit false information; or misuse our content, forms, promotions, or checkout.

3. Orders, pricing, and availability

All prices are shown in U.S. dollars unless stated otherwise. Taxes, shipping, discounts, and promotions are calculated at checkout. We may correct pricing or listing errors, limit quantities, reject or cancel an order before fulfillment, or discontinue a product when inventory is unavailable or an order appears fraudulent. If we cancel a paid order before fulfillment, the amount collected for that order will be returned through the original payment method as required by law.

Your order is not accepted until payment is authorized and we send an order confirmation. Items placed in a cart are not reserved. Promotions cannot be combined unless their terms expressly allow it.

4. Shipping

Orders are shipped only to destinations and by methods shown as available at checkout. Fragrance is subject to carrier and transportation restrictions and is generally shipped by eligible ground service. Delivery dates are estimates, not guarantees. Customers are responsible for providing a complete, accurate, and deliverable address. Our full preparation, shipping, tracking, and carrier-delay terms appear in our Shipping Policy.

5. Final sales and transit issues

Because fragrance decants are personal-use products filled for the customer, all sales are final except where applicable law requires otherwise. We do not accept returns, exchanges, cancellations, or preference-based refunds. Claims involving a damaged, leaking, missing, or incorrect item must follow the timing and evidence requirements in our Return and Refund Policy. Approved claims are resolved according to that policy.

6. Product use and safety

Fragrance is for external use only. Keep products away from children, pets, eyes, heat, flame, sparks, and ignition sources. Do not ingest fragrance. Stop use if irritation occurs. Review ingredient or allergen information from the original manufacturer when sensitivities are a concern, and patch test before broader use. You are responsible for using and storing products safely.

7. Intellectual property

The ArkXFragrance name, logo, website design, original graphics, photographs, descriptions, quiz content, and other original Store materials belong to ArkXFragrance or are used with permission. You may not copy, reproduce, sell, publish, scrape, or commercially exploit those materials without prior written permission. Third-party brand names and trademarks remain the property of their respective owners.

8. Third-party services

The Store is hosted by Shopify and may use payment processors, carriers, analytics providers, and other third-party services. Those providers may process information or apply their own terms and policies. Links to third-party websites are provided for convenience; we are not responsible for their content, availability, or practices.

9. Disclaimer and limitation of liability

To the fullest extent permitted by law, the Store and its content are provided “as is” and “as available.” We do not guarantee that the Store will always be uninterrupted, error-free, or secure, or that a fragrance will produce a particular personal reaction, performance result, or compliment. To the fullest extent permitted by law, ArkXFragrance will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Store or products. Nothing in these Terms limits rights or remedies that cannot legally be excluded.

10. Indemnification

To the extent permitted by law, you agree to indemnify and hold ArkXFragrance and its service providers harmless from third-party claims arising from your unlawful use of the Store, your breach of these Terms, or your violation of another person’s rights.

11. Governing law and severability

These Terms are governed by the laws of the State of New Hampshire and applicable federal law, without regard to conflict-of-law principles. If any provision is found unenforceable, the remaining provisions remain in effect.

12. Changes and contact
